Annual Filing Requirements - For Nonprofits Operating in Georgia

Most nonprofits will be mandated to register and annually renew their tax-exempt status with the state, though some organizations may be eligible to apply for exemptions. Georgia has some filing requirements that can be challenging, so we encourage Georgia Nonprofits to keep really goo financial records of their organization. We've highlighted some key areas to pay attention to keep your nonprofit in good standing with the State of Georgia.

Charity Registrations

Required to complete and file annually. Charity Registration, sometimes called a Permit to Solicit, is required to ask people and companies for donations in the state of operation. 

Due Date: A charitable organization registration is valid for a period of twenty-four (24) months from its effective date and must be renewed on or before its expiration date. The renewal application period opens ninety (90) days before the organization's expiration date.

Annual Reports

An annual report is required for a domestic or foreign nonprofit corporation.

Due Date: Must be Filed every 2-years or any year in which a material change has occurred, by April 1st. 

Other Exemptions

If desired, Georgia organizations are required to apply for a State Income Tax Exemption. There is no sales tax exemption. 

Tax Returns

All organizations (except those classified as churches) are required to file annual 990 form (990N, 990EZ, 990 or 990PF) to be exempt from Income Tax.
The return is due on the 15th day of the 5th month after the end of the organization's fiscal year. Failure to file for 3 consecutive years could make
your organization lose tax-exempt status.
